By accessing and using Ovation (operated by FertLog, available at fertlog.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service. We reserve the right to modify these terms at any time. Your continued use of the service following the posting of revised terms means you accept and agree to the changes.

2. Description of Service

Ovation is a web-based platform designed to provide fertility tracking, educational content, and informational resources related to reproductive health. The service includes features such as cycle tracking, data visualization, personalized insights, and access to educational materials about fertility, menstrual health, and reproductive wellness.

Ovation is provided on an "as-is" and "as-available" basis. We make no guarantees regarding the accuracy, completeness, or reliability of any information, calculations, or predictions provided through the platform. The service is intended for informational and entertainment purposes only.

3. User Accounts

To access premium features of Ovation, you must create a user account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you meet this age requirement.

You agree not to use the service for any unlawful or prohibited purposes. You agree not to interfere with the operation of Ovation or attempt to access it through unauthorized means.

4. Payment Terms

4.1 Subscription Pricing

Ovation offers a premium subscription service at $9.00 per month (USD). This subscription provides access to all premium features of the platform. Pricing is subject to change with thirty days' notice. Any price changes will apply to your next billing cycle.

4.2 Billing

Your subscription will be billed automatically on a monthly basis on the anniversary date of your subscription start date. You authorize us to charge your payment method on file for all fees and charges incurred through your account. If your payment method is declined, we will attempt to collect payment using an alternative method you have provided. If payment cannot be collected, we may suspend or terminate your access to the service.

You are responsible for maintaining current and accurate payment information. All fees are exclusive of applicable taxes, which you agree to pay in addition to subscription fees as required by law.

4.3 Cancellation Policy

You may cancel your subscription at any time by accessing your account settings or contacting our support team. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features through the end of the paid period. No refunds will be issued for partial months of service.

We reserve the right to cancel your account at any time for violation of these Terms of Service or other violations of law or our policies. Upon cancellation by us, you will lose access to your account and associated data.

4.4 Refund Policy

Ovation does not offer refunds for subscription fees paid for completed billing periods. In the event of a billing error or duplicate charge, please contact our support team within thirty days of the erroneous charge. We will investigate the claim and issue a refund if an error is determined to have occurred. Refunds will be issued to the original payment method within ten to fourteen business days.

If you experience a service outage lasting more than seven consecutive days due to our technical failure, you may request a pro-rata refund for the affected period. Such requests must be submitted within thirty days of the service restoration.

5. Intellectual Property Rights

All content, features, and functionality of Ovation, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, are the exclusive property of FertLog or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Ovation for personal, non-commercial purposes only. You may not reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any content, features, or functionality obtained through Ovation without our prior written consent.

You retain all rights to any content you submit to Ovation, including personal data and tracking information. By submitting content, you grant FertLog a non-exclusive, worldwide, royalty-free license to use such content for the purpose of operating and improving the service.

6. Limitation of Liability

To the fullest extent permitted by applicable law, FertLog and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of or inability to use Ovation, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

Our total liability to you for all claims arising from or relating to your use of Ovation shall not exceed the amount you have paid to FertLog in the twelve months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

7. Disclaimer of Medical Advice

Ovation is provided for entertainment and informational purposes only. The information, content, and tools provided through this platform are not intended to constitute professional medical advice, diagnosis, or treatment. Ovation is not a substitute for professional medical consultation with a qualified healthcare provider.

The fertility tracking calculations, predictions, and insights provided by Ovation are based on statistical models and user-provided data and are not guaranteed to be accurate. No fertility prediction tool can be 100 percent accurate. You should not rely on Ovation for purposes of contraception or fertility treatment planning without consulting with a healthcare professional.

Under no circumstances should you delay, disregard, or discontinue professional medical advice or treatment based on information obtained through Ovation. If you have specific medical concerns or are seeking treatment for infertility, menstrual irregularities, or any other health condition, please consult with a qualified healthcare provider.

FertLog makes no representations or warranties regarding the accuracy, completeness, safety, or reliability of any information, calculations, or predictions provided through Ovation. We do not endorse any particular course of action or medical treatment based on use of our platform.

8. Health and Safety Disclaimer

Your use of Ovation is at your own risk. We are not responsible for any adverse health outcomes, complications, or injuries resulting from reliance on information or insights provided through the platform. We do not screen users for medical contraindications or health conditions that may make certain uses of the platform inadvisable.

If you experience severe abdominal pain, excessive bleeding, signs of infection, or any other serious health emergency, seek immediate emergency medical care rather than relying on Ovation.

11. Changes to Terms of Service

FertLog reserves the right to modify these Terms of Service at any time in our sole discretion. Material changes will be communicated to you by email or by posting a prominent notice on the Ovation website. Your continued use of Ovation following the posting of modified terms constitutes your acceptance of the changes. If you do not agree with any modifications, you must cease use of the service and cancel your subscription.

12. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FertLog regarding the use of Ovation and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.
